再生債務額の確定／過払い請求を本人訴訟で行うワケ
個人民事再生における再生債務額が今日をもって確定される。
裁判所へ提出した債権者一覧表に基づき、債権額に変更があれば、債権者の皆様から提出される再生債権の届出によって債務大王の再生債務額が決まるのである。
弁護士先生には全ての債務内訳を提出したので、債権者が増えるということは無いだろう。
債務額については利息制限法により利息の引き直し計算をしているので、最初に弁護士先生へ提出した債務合計額からだいぶ下がっている。
下げ幅の大きかった消費者金融は、利用期間が最も長く借金額も多かった「初めての」さん。
利用限度枠最大であった２２０万の借金が、利息制限法により約６０万円まで減ったのは自分でも驚きでして。
利用していた消費者金融とクレジット会社の負債合計は約８００万強。
その債務はグレーゾーン金利部分が剥がされることにより、消費者金融系の債務額は６００万以下へと減額され、債務大王の払い過ぎていた利息は２００万円超という事実も判明したのでありました。
グレーゾーン金利といわれる「過払い利息」は、利息制限法上明らかに払い過ぎであっても、一利用者の単なる請求では返還されないだろう。
なので、自分は完済している消費者金融には訴訟をもって請求をするのであるが。
もちろん、法の力の行使できる弁護士・司法書士の先生に依頼するのであれば訴訟外での和解という選択肢もあるかもしれないが、先生たちは仕事であるが故、事を成立させるための依頼金と成功時の報酬が必要とされるのは当然であり。
その着手金や成功報酬は必ずしも安い金額とはいえないし、万が一失敗に終われば全てが水の泡と化すこともあり得るわけでして。
そういえば、人生再生決死隊の一員であるmpapaさんのバカにつける薬？？？から辿り着いたブログに興味を惹かれることを発見！
自分はこのようなことにならないためにも訴訟に関する知識は最低限でも勉強せねばイカンと痛感です。

さてさて、なぜ、訴訟など法の力を行使しないと「過払い金返還請求」に消費者金融は応じないのだろう？ということは常々よく考える。
推察の域であるが、融資時に明示した利息は利用者との合意により「みなし弁済」が成立しているから返還の必要は無い、というのが答えではなかろうか。
しかし、みなし弁済の成立には厳しい要件があり、訴訟にいたればそのほとんどが「みなし弁済」の要件を満たすことなく貸し手側が敗北している。
実際、みなし弁済の要件を満たしていなくても、利用者であるあなたが29％前後の利息でも借りるといったじゃないんですか？それはお互い合意のことでしょ。
それでも返せというなら、みなし弁済が成立していない証拠をみせてね。返す相談はそれからですから。
というのが貸し手サイドの思惑だと思うっす。
返還請求に対して貸し手が故意にハードルを高くしているとは思わないし、企業が生き残りをかけた経営方針なら当然のことにさえ感じるのは自分だけだろうか。決して擁護するわけではなく、企業存続としての一般論ね。
それでも「利息制限法」は強行規定なのでそんな理由はまかりとおらないはずだし、返さない正当性を証明する立場は貸し手のほうじゃないかと思う部分もあるのですが。
現在、グレーゾーン金利問題で叩かれるのは必ず貸し手の消費者金融側。昔からダークなイメージがあるけれど、そもそも高い利息に合意して借金したのは借り手である自分。
少なくとも借りるときは高い利息に合意したのは事実だから。
逆の立場だったらやはり自分も安易に返還に応じることはないだろうな。あの手この手でなんとかして返還請求から逃れることを考えるだろう。
そういった思いもあるから、過払い請求は自分で必要なことを学び、自ら苦労を買ってまで「本人訴訟」により行うことに決めたのです。今お世話になっている弁護士先生に依頼したら事の解決は簡単ということは承知のうえ。
原告敗訴で過払い金が返還されないことがあれば、自分は力不足だったということで。
本人訴訟による過払い金返還請求も、人生再生に欠かすことのできない体験かと（笑）

僕は崖ップチ間際で事務所に駆け込んでしまって、正直、無知な状況でした。。
今こうやって落ち着いて調べて行くと「特調」の方がよかったかな？とか色々悔やむことも出てきてるのが正直な気持ちです。
僕はまだ和解中なので正確な金額は出てませんが５０万円以上は費用で消えます、確実に。
しかし、その分は、以前に完済した分の過払い返還金で補えるのですが、当時借りて苦労させてしまった両親に返せるなら返したいものです。
今日は体調最悪ですよ～（笑）
消費者金融の利息は恐ろしいですね。
私も期間が短かったし完済していた時期もあった、金利も安いものに切り替えてた…
にもかかかかわらず、
400万円が半分になっていました。
こうしてみると…

再生決死隊…とは、債務大王さんの意気込みを感じます。
再生債務額、満足とはいかなくても納得のいく数字に落ちついてくれればいいですね。
過払いについては、小生ごときが口出しする必要が全く無いほどに研究されておられると感じます。…が、たまたま、つい最近体験しました「はじめての…」社の２３０万程の返還について参考になれば、と思って入れてみます。
小生は債務整理の何たるかも、何の知識も無いまま近くの司さんに駆け込んだ身でありますが、多くの方が最初感じられるであろう「仕事（進捗具合）の経過」が分らなくていらいらしておりました。ご多聞に洩れず、自分から司さんに問い合せるのも憚られ、ネットで情報収集の日々でした。
その中で、「過払い.com」というサイトで「自分でやりなさい」と力づけをしてくれるものがあったのですが、既に司さんに委任している部分があったために、信義上の問題が発生するのを恐れて断念しました。ただこのとき、返済ずみの取引を思い起こさせてくれたのです。
それが「￥…」さんと「はじめての…」さんです。
経緯は後ほどにして、結果は司委任で「￥」８０万、司→本人訴訟で「はじめ…」２３０万の返還となりました。
この本人訴訟は金額的に司さんの代理権がないためですが、これが勉強のきっかけになったことは否めません。そして、弁さんや司さんなら、あきらめた（かもしれない）ようなことも自分なら主張できることも知りました。

オイラは司法書士に任せて任意整理をしたッス。利息制限法への引きなおし計算は自分でもやってみて、それをもって司法書士のところに行きました。過払い請求も

司さんだと訴額１４０万超の地裁案件は扱えないから本人訴訟になったのですね。

関連するコメになりますので、この欄を使わせてもらいます。cheeseさんのページで紹介されてますが、貸金業法の改正は債務者に必ずしも有利とは思えませんので、返還訴訟を行うのであればできるだけ早いほうがいいと思います。
今回小生の体験した訴訟において最も重要だったのは、業者の出す「取引明細書」だと実感しました。
債務大王さんの取引状況が解りませんので、該当するかどうか分りませんが、業者が主張する主なものは、
１、みなし弁済の成立（これは一応形として持ち出してくる）
２、消滅時効の成立（１０年経過したものの無効）
３、一連の取引の分断（完済後は新貸付）
４、悪意の受益者ではない（１と同じ）
５、素人に解りづらい「判例」を持ち出す（よく読んでみると、事件名と判決の内容が異なる）
６、確たる理由の無い否認（和解交渉に持込むため）
裁判においては１、４は殆んど争点になることはないと考えられますので、参考本などの表現で訴状を作成すればよいでしょう。
２，３については、小生の場合、１０年以上前からのもので完済期間があったほか、不動産担保貸付が含まれていたので、弁・司さんも少し危惧していました。
この辺りが、専門家ですと妙に納得しても仕方が無いところですが、自分で訴状を作成するとなると、かなり理屈付けすることが出来ます。
小生の場合は、業者発行の「取引明細書」が担保付契約を含め「一連の取引」として記載されていたこと及び業者が云う完済日には過払い利息の元本充当によりマイナス残債務であること（みなし上の残高と法律上の残高）を主張して「取引の継続性」ということで対応してみました。
あと、商事法定利率の適用や取引終了日からの遅延利息の請求は参考本のうち理論的に主張できるものを選択すればよいと思います。
と、ここまではほぼ完璧と思ってはいたのですが、１回目の口頭弁論で相手の擬制陳述、全面否認にあい、裁判の長期化を避けたい気持があったものですから和解の打診をしてしまいました。
業者が、こちらの主張は「ご尤も」と折れる姿勢を示したものですから、「早期入金」という甘い条件にコロッと乗ってしまい「遅延利息」部分を大幅に妥協してしまいました。
ここが余裕の無い勝負の悲しさ、です。
ちょっと長くなりましたが、この自己訴訟の後押しをしてくれたのがcheeseさんの「時効を考える」という記事でした。判例をつぶさに読み理解することの重要性を認識させてくれました。
もし、具体的なことで連絡あれば、お答えできることもあるかと思います。

一応、証拠として要件を満たさない明細があります。
２は危惧するところもありますが、入手している取引明細が一連で表示されているので大丈夫かな？と。３にも関連しますね。
４・５・６は何とかなるかな？なんて甘い考えもあったりします。
先方の担当さんと電話で交渉した内容をメモしているし、聞いてないよ～なんて言わせないようにしなきゃならんです。

Speaking of users, the Zune "Social" is also great fun, letting you find others with shared tastes and becoming friends with them. You then can listen to a playlist created based on an amalgamation of what all your friends are listening to, which is also enjoyable. Those concerned with privacy will be relieved to know you can prevent the public from seeing your personal listening habits if you so choose.

Apple now has Rhapsody as an app, which is a great start, but it is currently hampered by the inability to store locally on your iPod, and has a dismal 64kbps bit rate. If this changes, then it will somewhat negate this advantage for the Zune, but the 10 songs per month will still be a big plus in Zune Pass' favor.
If you're still on the fence: grab your favorite earphones, head down to a Best Buy and ask to plug them into a Zune then an iPod and see which one sounds better to you, and which interface makes you smile more. Then you'll know which is right for you.

Zune and iPod: Most people compare the Zune to the Touch, but after seeing how slim and surprisingly small and light it is, I consider it to be a rather unique hybrid that combines qualities of both the Touch and the Nano. Dont get either. There are a lot of good guns for 150. I just got an inver mini used for 150, and it is an amazing gun. It needs hpa, and cannot use co2 though.
